Has the small claims limit gone up yet?

No. As of today the small claims track limit remains £10,000 for most money claims. The Civil Justice Council's review is ongoing and has not resulted in any change to the Civil Procedure Rules.

When will we know if it's changing?

The Council has said a report is expected later in 2026, but has not published a firm date. Even once a report lands, any actual change to the Civil Procedure Rules would need its own separate process and implementation date — this is unlikely to be quick.

Does this review apply to personal injury or housing disrepair claims?

Those claim types already sit under different, lower small claims thresholds than the general £10,000 figure and are being considered as part of the same review, but the specific rules for them are outside what Start My Claim currently covers. Check gov.uk or a solicitor for claim-specific figures.

If the limit rises, does that affect a claim I've already filed?

No. Track allocation is generally fixed at the point your claim is issued and allocated under the rules that applied at the time. A future change to the threshold would not retroactively move an existing claim onto a different track.

Should I wait to see what happens before filing my claim?

Generally, no. There's no confirmed date for any change, and your limitation period doesn't pause while you wait. If your claim is ready to bring under today's rules, waiting on a review with no set timeline mainly just adds risk.
