How long does a landlord have to return a tenancy deposit?

A landlord must return a tenancy deposit within 10 days of both parties agreeing how much should be returned. If there is a dispute, the deposit must stay protected in the scheme until it is resolved. Failure to return it promptly is a breach of contract that strengthens your small claims case.

What if my landlord never protected my deposit in a government scheme?

If your landlord failed to protect your tenancy deposit in one of the three government-backed schemes (DPS, MyDeposits, or TDS) within 30 days of receiving it, you can bring a county court claim for a penalty of between one and three times the deposit amount, on top of recovering the deposit itself. The court has no discretion on the minimum penalty — it must award at least the full deposit as a penalty.

Do I have to try scheme adjudication before going to court?

No. Adjudication through the deposit protection scheme and the small claims court are separate routes. You can go straight to court without trying adjudication first. However, if you skip adjudication and go to court, the judge may ask why you did not use the free scheme that was available to you. For disputed amounts, trying adjudication first is usually faster and carries no risk — an unfavourable decision does not prevent you from going to court afterwards.

How long do I have to make a deposit claim?

Six years. Under the Limitation Act 1980, claims in contract must be brought within six years of the breach. For a withheld tenancy deposit, that clock starts when the landlord failed to return it at the end of the tenancy. For the penalty claim arising from failure to protect a deposit, the six-year period runs from when the protection obligation arose — typically 30 days after you paid the deposit.

Can I claim interest on top of the deposit amount?

Yes. Under section 69 of the County Courts Act 1984, the court can award statutory interest at 8% per year on the amount owed, from the date it was due back to the date of judgment. For a deposit of £1,000 outstanding for one year, that adds £80 to your judgment. You claim this as part of your particulars of claim when you file.

What happens if I win in court but the other side does not pay?

Winning a judgment does not guarantee immediate payment. If the defendant ignores the judgment, you can apply for an enforcement order — a warrant of control (bailiffs), a third-party debt order against their bank account, or an attachment of earnings order. For landlords who own property, you can also register a charging order against their property. There is a further court fee for each enforcement step, which is added to the amount owed.
