Can I negotiate the terms, or is it take it or leave it?

You can. A settlement agreement is a negotiation, not a formal notice. The payment, the reference wording, the leaving date and other terms can usually all be discussed before you sign, normally through your adviser rather than directly.

My employer won't pay towards my advice. Do I still need it?

Yes — without independent advice on the terms and effect, condition three is not met and the agreement will not validly exclude your claim, regardless of who paid for the advice. Many advisers offer a fixed initial consultation fee, and knowing where you stand is worth paying for even if the deal ultimately falls through.

I've already signed. Can I get out of it?

Once a validly binding settlement agreement is signed, it is very difficult to unwind, broadly the same high bar as undoing any signed contract: fraud, misrepresentation, or a genuine mistake. That is exactly why the six conditions are worth checking beforehand rather than afterward.

What's the difference between this and an Acas COT3?

A COT3 is the form used when Acas itself conciliates a claim that has already been lodged, or is close to being lodged. Unlike a settlement agreement, it does not legally require you to take independent advice first, because an Acas conciliation officer is directly involved in reaching it instead.

Does signing stop me reporting something illegal my employer did?

Generally no. Section 43J of the Employment Rights Act 1996 makes any provision in an agreement void to the extent it tries to stop you making a protected disclosure, so a confidentiality clause cannot lawfully be used to prevent you reporting a crime to the police or a regulator.
