What is constructive dismissal?

It is when you resign because your employer has seriously broken your employment contract. Under section 95(1)(c) of the Employment Rights Act 1996, the resignation is then treated as a dismissal, so you can bring a claim as if you had been sacked.

Do I have to raise a grievance before I resign?

It is not a strict legal requirement, but Acas suggests raising the problem informally and then through a formal grievance. A tribunal can reduce your compensation by up to 25% if you unreasonably fail to follow the Acas Code, and a written grievance is strong evidence of what you objected to and when.

How long can I wait before resigning?

There is no fixed period. The longer you carry on without objecting, the more likely a tribunal is to find you accepted the breach. If you need time, say in writing that you are working under protest. Where there has been a series of incidents, a later last straw can revive earlier ones.

How much service do I need to claim constructive dismissal?

For constructive unfair dismissal, two years if your last day of employment is before 1 January 2027, and six months if it is on or after that date. Some reasons, such as pregnancy, whistleblowing or health and safety, need no minimum service, and neither do discrimination claims.

What is the deadline for a constructive dismissal claim?

Where your employment ends on or after 1 October 2026, six months less one day from your last day of employment. Before that date, three months less one day. You must contact Acas for early conciliation before you can file.

Can I resign with notice and still claim?

Yes. Section 95(1)(c) covers resigning with or without notice. Working your notice does not by itself mean you accepted the breach, but make clear in your resignation letter that you are leaving because of your employer's conduct.
