Can my employer sack me on the spot?

An employer can dismiss without notice for gross misconduct, but the Acas Code says a fair disciplinary process should always be followed first. That means an investigation, telling you the allegations, a meeting where you can respond, and a right of appeal. Skipping those steps makes it more likely a tribunal will find the dismissal unfair.

What is the difference between unfair and wrongful dismissal?

Unfair dismissal asks whether the employer had a fair reason and acted reasonably, and normally needs two years' service for dismissals before 1 January 2027. Wrongful dismissal is a breach of contract claim for notice pay you were owed and did not receive, and needs no qualifying service.

Does the 25% Acas uplift apply to the whole award?

No. In an unfair dismissal claim it applies to the compensatory award, not the basic award. Twenty-five per cent is the maximum, and the tribunal decides whether any uplift is just and equitable and how much.

If my employer skipped the process, will I definitely win?

Not necessarily. A procedurally unfair dismissal is still unfair, but compensation can be reduced if a fair process would probably have led to dismissal anyway (a Polkey reduction) or if your own conduct contributed to it.

Do I have to appeal before going to a tribunal?

No, but you should if you can. An unreasonable failure to use an appeal offered to you can lead to a reduction of up to 25% under the same rule that gives the uplift.

How long do I have to make a claim?

For dismissals on or after 1 October 2026, six months less one day from your effective date of termination; before that date, three months less one day. You must contact Acas for early conciliation before you can file.
