I bought from Wayfair during a countdown deal. Am I owed a refund?

Not automatically. The announcement does not include a refund scheme for Wayfair customers. You may have a personal claim if the countdown was a misleading action that was a significant factor in your decision, made within 90 days if you want to unwind the purchase, but you would need to make it yourself.

I was an Appliances Direct or Gold's Gym customer. What do I need to do?

The regulator says affected customers do not need to take any action and will be contacted by letter or email. If you believe you were affected and have not heard anything, write to the business with your order or membership details and ask whether you are included.

An extra charge appeared on my order because a box was already ticked. Can I get it back?

Usually, yes. Regulation 40 of the Consumer Contracts Regulations 2013 says a business needs your express consent for any payment on top of the main price, and consent cannot be inferred from a pre-ticked box or other default option. If it took the payment anyway, it has to refund it.

Is 90 days a strict deadline?

For unwinding a contract under the 2008 Regulations, yes. You must reject the goods or service within 90 days, which generally runs from when the goods were delivered or the service began. After that, a discount or damages may still be available, and a breach of contract claim in England and Wales generally has six years.

Can I claim if the CMA has never looked at the business I bought from?

Yes. Your rights under the Consumer Contracts Regulations and the 2008 Regulations do not depend on any regulator having investigated. You would need your own evidence of what the business did and of how it affected your decision.
