Particulars of claim builder and worked examples
Every particulars of claim contains these seven things. Skip any and the defendant can apply to strike out the claim for lack of particularity.
Full name and address of claimant. Full name and address of defendant. For a company, the registered office.
Numbered paragraphs setting out the relevant history — when you met, what was agreed, what each side did. Chronological order, plain English.
The contract / cause
When the contract was made (date), what was agreed (price, scope, deliverables), what form (written / verbal / part written). For non-contract claims, the legal basis (negligence, statutory tort, etc.).
What the defendant did or failed to do that gives rise to the claim. State the date of the breach and what specifically was wrong.
What it cost you, broken down. Principal + interest + consequential losses. Each line item has a figure attached.
"The Claimant claims £X plus interest pursuant to section 69 of the County Courts Act 1984 plus court fees."
"I believe that the facts stated in these particulars of claim are true. I understand that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth." Then signed and dated.
