How much does it cost to take someone to small claims court in Birmingham?

The same as anywhere in England and Wales. The issue fee depends on how much you claim (see the fee table on this page), and if the claim goes to a hearing the claimant usually pays a hearing fee as well. If you win, the court normally orders the other side to repay your court fees.

Can you get a CCJ from the small claims court?

Yes. If the court orders someone to pay money, that is a county court judgment (CCJ). It goes on the public register unless it is paid in full within one month of the judgment.

Do I have to go to Birmingham if the defendant lives elsewhere?

Not always. A defended claim against an individual for a fixed sum of money is normally sent to the defendant’s home court, which may be outside Birmingham. Many small claims hearings can also be held by video.
